WorkSafe Transition period ends exactly two months from today 30th January 2026

The clock is ticking. Today, there are exactly two months until the lengthy transition period relating to mines statutory positions in the Work Health and Safety (Mines) Regulations 2022 ends.

On or before 30 March, workers appointed to statutory positions must pass the work health and safety (WHS) legislation examinations and WHS risk management units that are relevant to their roles. Some statutory positions require their appointees to hold statutory certificates. Also on or before 30 March, workers who want to transition their certificates of competency to statutory certificates must lodge copies of their existing certificates as well as proof that they have passed the WHS legislation exams and risk management units that are relevant to their roles.

After 30 March, the Department of Local Government, Industry Regulation and Safety won’t accept applications for transitioning existing certificates. Also after 30 March, WorkSafe Mines Safety inspectors will monitor compliance with statutory position-related legislation during their inspections of mine sites.

Seats available at more than 200 exam sessions

WorkSafe will run more than 200 WHS legislation examination sessions across its Perth, Bunbury and Kalgoorlie test venues between 1 February and the end of the transition period on 30 March.

Candidates can reserve seats at sessions on the Mines Statutory Positions Program portal. As 30 March approaches, demand for seats is increasing. WorkSafe requests that candidates cancel any unnecessary bookings to free up spots for other people.

WorkSafe clarifies Statutory Supervisor positions

WorkSafe has conducted a comprehensive review of the drafting documents associated with the development of the regulations. The purpose of the extensive review was to clarify the regulatory intent regarding the appointment of Statutory Supervisors and resolve several areas of ambiguity so that WorkSafe could provide consistent interpretation and messaging to Western Australia’s mining industry.
